These terms and conditions (User Terms) apply to your visit to and your use of the website and Services at www.homecabs.com(the Website) whether through a computer or a mobile phone, the Service, and the Application (as defined below), as well as to all information, recommendations, and/or services provided to you on or through the Website, the Service, and the Application. For the purposes of these User Terms, Sindon HomeCab India Pvt Ltd shall mean Sindon HomeCab India Pvt Ltd. “You” means a person who meets the eligibility criteria set out below.

PLEASE READ THESE USER TERMS CAREFULLY BEFORE DOWNLOADING OUR APPLICATION AND/OR USING OUR WEBSITE.

SERVICES PROVIDED

Sindon HomeCab India Pvt Ltd offers information and a means to obtain transportation services offered by third-party transportation providers, drivers, or vehicle operators (the "Transportation Provider"), which may be requested through the use of an application supplied by Sindon HomeCab India Pvt Ltd, downloaded and installed by you on your smartphone (the Application) or through any other channel made available by Sindon HomeCab India Pvt Ltd for real-time tracking of your ride and booking purposes. All services provided by Sindon HomeCab India Pvt Ltd to you by means of your use of the Application are hereafter referred to as the "Service".

CONTRACT BETWEEN YOU AND Sindon HomeCab India Pvt Ltd

“User(s)” means any individual or business entity/organization that legally operates in India or in other countries, uses, and has the right to use the Services provided by Sindon HomeCab India Pvt Ltd. By using the Application or the Service, you enter into a contract with Sindon HomeCab India Pvt Ltd (the "Contract"). In order to be able to use the Application or Service, you first need to sign up with Sindon HomeCab India Pvt Ltd. When signing up, you are obligated to provide Sindon HomeCab India Pvt Ltd with your personal information, mobile telephone number, and credit card data. Upon successful completion of your sign-up with Sindon HomeCab India Pvt Ltd, Sindon HomeCab India Pvt Ltd will provide you with a personal account, accessible to you with a password of your choice.

If you reside in a jurisdiction that restricts the use of the Service or Application because of age, or restricts the ability to enter into contracts such as this one due to age, you must abide by such age limits and you must not use the Service and the Application. You represent that if you are an individual, you are of legal age to enter into a binding contract, or that if you are registering on behalf of a legal entity, that you are authorized to enter into, and bind the entity to, these User Terms and register for the Service and the Application.

Sindon HomeCab India Pvt Ltd advises its users that while accessing the website, they must abide by the applicable laws. Sindon HomeCab India Pvt Ltd is not responsible for any consequences caused by your behavior during the use of services provided by Sindon HomeCab India Pvt Ltd. Sindon HomeCab India Pvt Ltd may, in its sole discretion, refuse the Service to anyone at any time.

This Agreement applies to user(s) whether they are visitors, registered – free or paid – users who access the Application and website for any purpose. It also applies to any legal entity which may be represented by you under actual or apparent authority. User(s) may use this site solely for their own personal or internal purposes.

HOW TO USE THE APPLICATION AND SERVICES PROVIDED

The Application allows you to send a request for transportation service to a Transportation Provider. The GPS receiver—installed on the mobile device (smartphone) on which you have downloaded the Application—detects your location and sends your location information to the relevant Transportation Provider. The Transportation Provider has sole and complete discretion to accept or reject each request for transportation service. The Transportation Provider also has sole and complete discretion over whether to use the Application to receive the leads generated through the Application. If the Transportation Provider accepts a request, the Application notifies you and provides information regarding the Transportation Provider—including its name, vehicle registration number, and customer service rating—and the ability to contact the Transportation Provider by telephone. The Application also allows you to view the Transportation Provider's progress toward the pick-up point in real time.

Sindon HomeCab India Pvt Ltd shall make reasonable efforts to bring you into contact with a Transportation Provider in order to obtain transportation services, subject to the availability of Transportation Providers in or around your location at the moment of your request for transportation services.

For the avoidance of doubt: Sindon HomeCab India Pvt Ltditself does not provide transportation services, and Sindon HomeCab India Pvt Ltd is not a transportation carrier. It is up to the Transportation Provider to offer transportation services, which may be requested through the use of the Application and/or the Service. Sindon HomeCab India Pvt Ltdonly acts as an intermediary between you and the Transportation Provider. The provision of the transportation services by the Transportation Provider to you is therefore subject to the agreement (to be) entered into between you and the Transportation Provider. Sindon HomeCab India Pvt Ltd shall never be a party to such agreement.

MANNER OF USE OF THE APPLICATION AND SERVICES BY YOU

You warrant that the information you provide to Sindon HomeCab India Pvt Ltd is accurate and complete. Sindon HomeCab India Pvt Ltd is entitled at all times to verify the information that you have provided and to refuse the Service or use of the Application without providing reasons.

You may only access the Service using authorized means. It is your responsibility to ensure you download the correct Application for your device. Sindon HomeCab India Pvt Ltd is not liable if you do not have a compatible mobile device or if you download the wrong version of the Application for your mobile device. Sindon HomeCab India Pvt Ltd reserves the right to terminate the Service and the use of the Application if you are using the Service or Application with an incompatible or unauthorized device.

By using the Application or the Service, you further agree that:

You will only use the Service or download the Application for your sole, personal use and will not resell it to a third party;
You will not authorize others to use your account;
You will not assign or otherwise transfer your account to any other person or legal entity;
You will not use an account that is subject to any rights of a person other than you without appropriate authorization;
You will not use the Service or Application for unlawful purposes, including but not limited to sending or storing any unlawful material or for fraudulent purposes;
You will not use the Service or Application to cause nuisance, annoyance, or inconvenience;
You will not impair the proper operation of the network;
You will not try to harm the Service or Application in any way whatsoever;
You will not copy or distribute the Application or other Sindon HomeCab India Pvt Ltd content without written permission from Sindon HomeCab India Pvt Ltd;
You will keep secure and confidential your account password or any identification provided by Sindon HomeCab India Pvt Ltd which allows access to the Service;
You will provide us with whatever proof of identity we may reasonably request;
You will only use an access point or data account which you are authorized to use;
You are aware that when requesting transportation services by SMS or by using the Application, standard messaging charges will apply;
You will not use the Service or Application with an incompatible or unauthorized device;
You will comply with all applicable laws from your home nation, and the country, state, and city in which you are present while using the Application or Service.

Sindon HomeCab India Pvt Ltd reserves the right to immediately terminate the Service and the use of the Application should you not comply with any of the above rules.

PAYMENT

You understand that use of the Services may result in charges to you for the services you receive ("Charges"). Sindon HomeCab India Pvt Ltd will receive and/or enable your payment of the applicable Charges for services obtained through your use of the Application. Charges will be inclusive of applicable taxes where required by law. Charges may include other applicable fees, tolls, and/or surcharges including a booking fee, municipal tolls, airport surcharges, or processing fees for split payments. All Charges and payments will be enabled by Sindon HomeCab India Pvt Ltd using the preferred payment method designated in your Account, after which you will receive a receipt by email. If your primary Account payment method is determined to be expired, invalid, or otherwise not able to be charged, you agree that Sindon HomeCab India Pvt Ltd may use a secondary payment method in your Account, if available.

As between you and Sindon HomeCab India Pvt Ltd, Sindon HomeCab India Pvt Ltd reserves the right to establish, remove, and/or revise Charges for any or all services obtained through the use of the Services at any time in Sindon HomeCab India Pvt Ltd's sole discretion. Sindon HomeCab India Pvt Ltd will use reasonable efforts to inform you of Charges that may apply, provided that you will be responsible for Charges incurred under your Account regardless of your awareness of such Charges or their amounts. Sindon HomeCab India Pvt Ltd may from time to time provide certain users with promotional offers and discounts that may result in different amounts charged for the same or similar services obtained through the use of the Services, and you agree that such promotional offers and discounts, unless also made available to you, shall have no bearing on your use of the Services or the Charges applied to you. You may elect to cancel your request for services from a Transportation Provider at any time prior to such Transportation Provider's arrival, in which case you may be charged a cancellation fee.

This payment structure is intended to fully compensate the Transportation Provider for the services provided. Any representation by Sindon HomeCab India Pvt Ltd (on Sindon HomeCab India Pvt Ltd’s website, in the Application, or in Sindon HomeCab India Pvt Ltd’s marketing materials) to the effect that tipping is "voluntary," "not required," and/or "included" in the payments you make for services provided is not intended to suggest that Sindon HomeCab India Pvt Ltd provides any additional amounts, beyond those described above, to the Transportation Provider. You understand and agree that while you are free to provide an additional payment as a gratuity to any Transportation Provider who provides you with services obtained through the Service, you are under no obligation to do so. Gratuities are voluntary.

DAMAGES OR CLEANING FEES

You shall be responsible for the cost of repair for damage to, or necessary cleaning of, vehicles and property resulting from the use of the Services under your Account in excess of normal "wear and tear" damages and necessary cleaning ("Repair or Cleaning"). In the event that a Transportation Provider reports the need for Repair or Cleaning, and such a Repair or Cleaning request is verified by Sindon HomeCab India Pvt Ltd in Sindon HomeCab India Pvt Ltd's reasonable discretion, Sindon HomeCab India Pvt Ltd reserves the right to facilitate payment for the reasonable cost of such Repair or Cleaning on behalf of the Transportation Provider using your payment method designated in your Account. Such amounts will be transferred by Sindon HomeCab India Pvt Ltd to the applicable Transportation Provider and are non-refundable.

Should a Transportation Provider report to Sindon HomeCab India Pvt Ltd that you have materially damaged the Transportation Provider's vehicle, you agree to pay for the reasonable cost of such Repair or Cleaning via the payment method you have on file with Sindon HomeCab India Pvt Ltd.

You agree to cooperate with and assist Sindon HomeCab India Pvt Ltd in good faith, and to provide Sindon HomeCab India Pvt Ltdwith such information and take such actions as may be reasonably requested by Sindon HomeCab India Pvt Ltd, in connection with any complaints or claims made by Transportation Providers or third parties with respect to (i) goods or services offered or provided by you, (ii) your use of the Services, or (iii) breach of any of these Terms of Use. If you have a dispute with one or more Transportation Providers, you release Sindon HomeCab India Pvt Ltd (and Sindon HomeCab India Pvt Ltd's officers, directors, agents, subsidiaries, joint ventures, and employees) from any and all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.

CANCELLATION POLICY

You may cancel an order within a certain timeframe as specified on the Website. The cancellation window varies by city and may change from time to time. To view the cancellation window applicable to you, please check the Website. Please note that not all orders are eligible for cancellation. Cancellation of an order after the specified cancellation window may result in cancellation fees.

TERMINATION

You may terminate this Agreement at any time, provided that you discontinue any further use of the Services. Sindon HomeCab India Pvt Ltd may terminate this Agreement at any time and for any reason, including, but not limited to, violation of these Terms of Use, fraudulent or illegal use of the Services, or actions that may cause harm to others or Sindon HomeCab India Pvt Ltd. In the event of termination by Sindon HomeCab India Pvt Ltd for violation of these Terms of Use, any remaining balance in your account at the time of such violation may be forfeited, and you may be prohibited from using the Services in the future.

GOVERNING LAW AND DISPUTE RESOLUTION

These Terms of Use are governed by and construed in accordance with the laws of the State of [Your State], without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms of Use or your access or use of the Services will be subject to the exclusive jurisdiction of the state and federal courts located within the State of [Your State], and you hereby submit to the personal jurisdiction of such courts.

AMENDMENTS

Sindon HomeCab India Pvt Ltd may amend these Terms of Use at any time by posting the amended terms on the Website or within the Application. Except as otherwise stated in these Terms of Use, all amended terms will automatically be effective immediately after they are posted on the Website or within the Application. These Terms of Use may not be otherwise amended except in writing signed by you and Sindon HomeCab India Pvt Ltd. This Agreement sets forth the entire understanding and agreement between you and Sindon HomeCab India Pvt Ltd with respect to the subject matter hereof.
